Artikel 1
These terms apply to any use of the BirthdayDeal platform, all related websites, subdomains, mobile applications, email and marketing channels, prize draws, promotions and all other services and communications offered under or on behalf of BirthdayDeal.
Artikel 2
The terms also apply to current and future platforms, brands or domain names owned or managed by BirthdayDeal, insofar as they have the same or similar purpose.
Artikel 3
By using any of these services, the user accepts that the provisions of these terms apply in full to any use within this network of platforms.
Artikel 4
By using the platform or registering, the user declares to have fully read and unconditionally accept these terms.
Artikel 5
BirthdayDeal's services are aimed at consumers and partners who share information or promotions via the platform.
Artikel 6
The user guarantees to provide correct, current and complete data and indemnifies BirthdayDeal for damages due to incorrect or false information.
Artikel 7
The user remains fully responsible for actions that take place under their account.
Artikel 8
Access to certain parts may depend on age, place of residence or legal restrictions.
Artikel 9
Users under eighteen years of age need permission from a parent or guardian; explicit parental consent is required for processing data of persons under sixteen.
Artikel 10
BirthdayDeal may request proof of consent at any time; in its absence, access or participation will be terminated.
Artikel 11
All prize draws on the platform are promotional games of chance in accordance with the Promotional Games of Chance Code of Conduct and are accessible at no cost.
Artikel 12
Each campaign has a clear description, duration and prize overview published via the platform.
Artikel 13
A user can only participate once per campaign, unless explicitly stated otherwise.
Artikel 14
Entries with incomplete or incorrect data are invalid.
Artikel 15
Automatic submissions, scripts or bots are prohibited and lead to exclusion.
Artikel 16
The drawing of prizes takes place randomly and verifiably; afterwards, a manual check on age and validity takes place.
Artikel 17
Only after confirmation by the team is a winner definitively established.
Artikel 18
If it appears that the selected participant does not meet the conditions, an alternative winner will be designated.
Artikel 19
No correspondence will be entered into regarding results and the allocation of prizes.
Artikel 20
The probability of winning depends on the number of valid entries.

Prizes are personal, non-transferable and not exchangeable for money.
Artikel 22
The grand prize is drawn once one hundred thousand valid members have been reached, following the same procedure as other campaigns.

Winners receive notification via the specified contact channel; if there is no response within seven days, the prize lapses.
Artikel 24
The identity of winners may be verified by BirthdayDeal before prizes are awarded.
Artikel 25
Participants consent to publication of initials and place of residence in a results overview.
Artikel 26
Processing of personal data takes place in accordance with the GDPR and BirthdayDeal's Privacy Policy.
Artikel 27
Data is used exclusively for participation, drawing, communication, compliance and legal obligations.
Artikel 28
BirthdayDeal retains data for as long as necessary for the execution of the campaign or agreement.
Artikel 29
Marketing messages are only sent after opt-in and can be stopped at any time.
Artikel 30
Users can request access, correction or deletion of data via the specified contact method.
Artikel 31
BirthdayDeal may terminate accounts or participation in case of violation of these terms.
Artikel 32
The platform may be temporarily interrupted for maintenance, updates or security.
Artikel 33
BirthdayDeal is not liable for technical failures or unavailability of the platform.
Artikel 34
Use of the platform is entirely at the user's own risk.
Artikel 35
BirthdayDeal is not responsible for the behaviour or expressions of other users or partners.

Links to external websites fall outside the responsibility of BirthdayDeal.
Artikel 37
Partner companies that publish deals are themselves responsible for correct delivery, prices and compliance with legislation.

BirthdayDeal checks partners for reasonableness but does not guarantee the availability or quality of the offers.
Artikel 39
In the event of a dispute about a deal, the user is obliged to resolve this directly with the relevant partner.
Artikel 40
BirthdayDeal may block user or partner accounts in case of fraud or deception.
Artikel 41
All content on the platform, including logos and texts, remains the property of BirthdayDeal.
Artikel 42
Use of brand or image material without permission is prohibited.
Artikel 43
By submitting material, the user grants a limited licence for use for promotional purposes.
Artikel 44
The user guarantees that submitted material does not infringe on third-party rights.
Artikel 45
BirthdayDeal is not liable for claims from third parties arising from content placed by users.
Artikel 46
Any gambling tax on prizes won is, if legally required, for the account of the winner.
Artikel 47
Prizes may differ from the images shown; an equivalent alternative may be delivered.
Artikel 48
The participant indemnifies BirthdayDeal for damage resulting from incorrect or incomplete data.
Artikel 49
All communication between user and platform may be logged for evidence and security purposes.
Artikel 50
BirthdayDeal processes data within the EU or according to equivalent levels of protection.
Artikel 51
Using the platform for unlawful purposes is prohibited.
Artikel 52
The user will not spread viruses, spam or unwanted advertising via the platform.
Artikel 53
Abuse may lead to legal action or reporting.

BirthdayDeal reserves the right to remove content without prior warning.

If a campaign cannot proceed due to force majeure, claims to prizes lapse without right to compensation.

Force majeure means any circumstance beyond BirthdayDeal's control, including failures or legal restrictions.

Changes in legislation may lead to adjustment of campaigns or terms.

Amended terms take effect immediately upon publication on the platform.

Continued use after amendment constitutes agreement to the new terms.

BirthdayDeals may terminate promotions or replace them with new campaigns.
Artikel 61
Prizes already awarded will be honoured upon termination of a campaign.
Artikel 62
The user can delete their account at any time; remaining rights lapse upon deletion.

Deletion of data may affect participation or reward systems.

BirthdayDeal may adjust or discontinue reward or XP systems without compensation.

Any incorrect point counts do not give any right to payment or benefit.

Users declare to refrain from offensive or discriminatory statements.

In case of violation, access may be permanently denied.

In case of invalidity, the parties will agree on a new provision that is as close as possible to the original intent.

Using the platform does not create an employment relationship.

Partners are themselves responsible for compliance with labour and youth legislation in promotional activities.

BirthdayDeal reserves all rights not explicitly granted to users.

Failure to enforce a provision does not constitute a waiver of rights.

No part of these terms creates rights for third parties.

All amounts are stated in euros.

Communication by email is deemed to have been received within 24 hours of sending.

Users are advised to consult the terms regularly.

By using the platform, the user declares to be fully aware of all articles.

Every participation or registration implies the acceptance of these complete terms.

BirthdayDeal may publish additional rules for specific campaigns or features at any time.

BirthdayDeal may use collected data, provided in accordance with privacy legislation and only after consent or where legally permitted, for future services or affiliated platforms that have the same or similar purpose.
Artikel 108
These terms come into effect on the date of publication and remain valid until they are replaced by a new version.
Artikel 109
The term 'Main Prize', as referred to in these terms and conditions, refers to a single, one-time prize that will be drawn when the number of members mentioned in Article 22 is reached. The winner of this main prize has the right to choose from a pre-determined prize package. This package may consist of options such as (a) a cash amount, (b) a physical product, or (c) gift cards. The exact composition and value of the prize package will be announced prior to each campaign period. The visual representations on the platform serve as illustrations of the available choices and may differ from the actual offer. The winner's choice is final and cannot be exchanged for other prizes, cash, or alternative monetary value. Per campaign period, only one main prize will be awarded to one winner.
